Family Law Modifications in Toledo
Legal Strategies Tailored to Your Changing Family
Existing family law orders can fail to reflect a parent’s current job, a child’s changing needs, or a former spouse’s financial circumstances. Smith & Smith Law Office, LLC represents Toledo parents and former spouses seeking appropriate changes to child custody, visitation, and child support orders under Ohio law.
We’ve served families throughout the greater Lucas County area since 1999, focusing on family law. Our attorneys handle divorce, custody, support, and related matters, tailoring each legal strategy to the client’s needs and goals.

Routes for Modifying an Order in Lucas County
A modification matter generally starts with reviewing the existing order and the circumstances that have changed since it was issued. We assess the supporting documentation, determine the appropriate legal route, and pursue the required approval.
The Lucas County Court of Common Pleas, Domestic Relations Division hears post-decree motions involving custody, visitation, support for a child, and spousal support after a marriage ends. Depending on the issue, a request may proceed through a court motion, an administrative review, or mediation.
Relevant documentation may include:
- Financial records showing changes in income or expenses
- Parenting-time records related to custody or visitation
- Medical records connected to a parent’s or child’s health
- Other records directly supporting the claimed change in circumstances
Administrative Review of Support Orders
Either parent may request an administrative review through the Child Support Enforcement Agency or seek modification through the court. The agency reviews eligible orders every 36 months. The appropriate route depends on the order and the circumstances surrounding the request.
Mediation for Post-Divorce Changes
Mediation allows the parties to discuss possible terms and may produce more flexible or creative solutions than a judge’s final, binding decision. Any agreement that changes an existing custody or visitation order still requires court approval.
Modifying Child Support in Ohio
We handle support-order modifications involving significant changes in circumstances, including a substantial shift in income or a child’s needs. Relevant developments may include job loss, a promotion, relocation, changed parenting time, or a serious illness or injury involving a parent or child.
Under Ohio Revised Code 3119.79, a recalculated support amount that’s more than 10 percent greater or less than the existing amount is considered a substantial change of circumstance requiring modification. Inadequate health insurance coverage that leaves a child’s medical needs unmet can also satisfy this standard.
Either party may file a motion to modify support with the court that issued the original order. Ohio law doesn’t impose a time restriction on that motion, but supporting facts and documentation remain important.
Custody & Visitation Modifications in Toledo
A custody modification requires a significant change in circumstances affecting the child’s welfare or a parent’s situation. Job relocation and a child’s changing needs may warrant review. The court considers what has changed since the current order and how the proposed arrangement would affect the child.
Visitation changes are related but distinct. The proposed terms must serve the child’s best interests. Relocation, altered work schedules, or safety concerns may affect the analysis. An informal arrangement between parents doesn’t replace a court-approved order.
The Lucas County Domestic Relations Court’s Custody Assessment Department provides custody assessments, mediation, referral services, and shared parenting plan review. We prepare clients for the applicable process and present the facts supporting the proposed modification.
Changing a Support Award Depends on the Decree
The ability to pursue a spousal support modification depends on the existing divorce decree and whether the court retained authority over the award. The decree must reserve jurisdiction for the court to modify it, so we review that document before determining whether a change may proceed.
